Notification on ban on smoking

In the interest and welfare of public and in continuation of earlier press release NO. DHFW-22/NTCP/2/2008-2009 dt.30-09-2008 and in compliance with the provisions of COTPA, 2003 Section- 4,5 & 6 (Cigarette and Other Tobacco Product Act, 2003) the department of Health & Family Welfare has notified all concern that any one found smoking in the specified public places should be liable to be prosecuted under the provisions of the Act. Public places as per Revised Rules Vide. Ministry of Health & Family Welfare letter No.F.No.P-1605/20/2007-PH(Pt)Dt.1st Oct. 2008. Public places included, auditorium, hospital, buildings, health institutions, amusement centers, restaurants, hotels, public offices, court buildings, educational institutions, libraries public conveyances, open auditorium, stadium, railway stations, bus stops, work places, shopping mall, cinema halls, refreshments rooms, discotheques, coffee house pubs, bars, airport lounge and clubs. According to an official bulletin penalty would be given as per provisions of COTPA, 2003 (Cigarettes and Other Tobacco Products Act, 2003). Penalty included Prohibition of smoking in public places (Sec-4), violation of this provision is liable for a penalty of Rs.200/, prohibition of advertisement of cigarettes and other tobacco products (Sec-5). Violation of this provision carries a penalty of imprisonment of two years and a fine Rs.1000/- or with both in the case of the first conviction. In the case of second or subsequent conviction, penalty is imprisonment for 5 years and fine up to Rs. 5000/-. Prohibition of sale of Cigarette and Tobacco products to person below the age of 18 years (Sec-6(A) ), prohibition of sale of Cigarettes and Tobacco products within the radius of 100 yards of any Educational Institutions (Sec-6(B)). Violation of (Sec-6 (A) & (B)) carries a penalty of Rs.200/-. Public have notified to abstain from:- smoking in public places, selling of cigarettes and other tobacco products near the educational institutions and selling of cigarettes and other tobacco products to persons below the age of 18 years to avoid legal consequences.
