Notice to ex-DC Mkg

A notice was issued to former DC Mokokchung Imkontemsu to tender publish an “unqualified and unconditional apology” to CONgress MLA I.Imkong within two weeks failing which legal actgion would follow. This was contained in a legal notice issued on behalf of former CLP leader and senior Congress MLA, I. Imkong by Advocate A. Zhimomi in a defamation case. The notice cautioned the ex-DC of appropriate proceedings to be initiated against him at his own risk as to cost and consequences, if he failed to heed the requirements of the notice. The Advocate also told Imkongtemsu that in the event of institution of appropriate proceedings against him, the same shall be done without further reference to him. The notice pointed out that the apology was only “for revealing the matter at a public meeting at Khar village,” which he said “cannot by any stretch of the imagination be termed as an apology to my client.” He said the statements were nothing but a justification of Imkongtemsu’s defamatory statements against his client. He also said the apology was not acceptable in the eye of the law. The notice also pointed out that Imkongtemsu in his apology had claimed that he heard from a “very reliable source” that his client asked for NPF ticket for the Lok Sabha elections. He said Imkongtemsu had accused his client of having a track of record of “changing colour at regular intervals” who also reiterated that he was “not talking about a wild dream.” The Advocate told the ex-DC that he was now on record not only for the earlier defamatory statements but also for continuing the defamation in his “apology” and his admission of the fact that he based his statements on hearsay. “The statements made by you clearly reveal the hostile animus you bear towards my client and your intention to defame and tarnish his good name,” the Advocate told the ex-DC Mokokchung in the notice. The Advocate also said Imkongtemsu’s conduct in the issuance of the defamatory statements and the subsequent justification was reprehensible and deserved outright condemnation.
