Bails set aside

The Gauhati High Court Kohima Bench, on a petition by the Advocate General Nagaland challenging the pre-arrest bail granted by the lower courts set aside the bails of four of the five implicated in the bogus and illegal appointment scam in the education department and directed filing of fresh bail applications at the respective lower courts on June 18.The hearing on the pre-arrest bail of one had been deferred. The Vigilance Commission had obtained arrest warrants against those implicated in the bogus and illegal appointments of teachers in the education department during 2007,2008 and 2009. The High Court had set aside the pre-arrest bails granted to the SIS Mokokchung while deferring the case of the DIS who were granted bail by the same court of the Additional Sessions Judge,Mokokchung. On the same day, on June 12, the HC also set aside the pre-arrest bail granted by the court of the Additional Session Judge, Kohima to the following- a deputy secretary, under secretary and one LDA now serving in various departments. The Judge observed that the pre-arrest bails were granted without serving any notice to the prosecution( the Special Investigation Team) and without going through the merit of the case but hinged upon “irrelevant considerations”. It was disclosed that the accused implicated in the scam had got wind of the imminent arrest by the SIT and then approached the lower courts at Kohima and Mokokchung and obtained pre-arrest bail. The HC observed that the bails were in contravention of Section 438 under the Cr.PC
