Final hearing on Retirement Act today

With the second consecutive hearing on the writ petition filed by the Nagaland Senior Government Employees Welfare Association challenging the Nagaland Retirement from Public Employment Act, 2009 which took place at the Principle Bench, Gauhati High Court Wednesday, the final hearing has been scheduled for Thursday. According to a source, the argument by the counsel for the petitioner NSGEWA was heard Wednesday since it could be completed on Tuesday. Later, the Advocate General of Nagaland, representing Nagaland State Government also presented his argument today. Since the hearing could not be completed today, the last and final hearing was scheduled for Thursday. The court was likely to give its judgment after a couple of days after completion of the final hearing tomorrow. It may be mentioned that the State Government, bowing to the pressure of the Naga Student’s Federation, had passed the Nagaland Retirement from Public Employment Act, 2009 during the last assembly session. The Act prescribed the retirement of government employees to be determined either on attainment of 60 years of age or on completion of a total of 35 years length of service or whichever is earlier. Based on the Act, the state government had already issued official notification that the Act will come into effect from October 31 which would affect an estimated 3000 government employees. Government servants affected by the Act formed the Nagaland Senior Government Employees Welfare Association and filed a petition in the Gauhati High Court challenging the Act.
