Forum rejects CS statement

All Nagaland State Services 6th RoP Demand Forum has rejected the statement issued by the chief secretary, Lalthara in connection with the implementation of the 6th RoP who stated that government employees have no fundamental right to demand revision of pay scales. The Forum said it was not demanding any revision of pay scales or pay parity with IAS officers but the effective date for implementation of the 6th RoP “in toto” w.e.f January 1, 2006 as has been given to All India Services (AIS). Buttressing its point of demand, chairman of the Forum, Dr. K. David Sema and secretary, Vekho Vero in a joint statement said that the AIS and the state services were all serving the same government with provisions of equal right and non-discrimination guaranteed by the Indian constitution.
The Forum took exception to the chief secretary’s statement, “Government employees do not have any fundamental rights under the Service Rules for their periodic revision of pay scales.” To this, the Forum said, “as if the fundamental rights are guaranteed for All India Services only to avail all the benefits and facilities in time, while the State services are left out saying that the State services do not have the fundamental rights.”
On the 5th RoP, the Forum said that the actual implementation was to be effective from 2000 but was fixed with notional pay fixation from October 1998 thereby causing loss of two years benefit for the state government employees. In this regard, the Forum said what was deprived to the employees should not be taken as a right precedence by the government in the present case.
It was pointed out that the DA or ADA was being granted to the government employees to defray price hike, which the Forum said should not be taken as an adequate measure to compensate the price hike as the AIS employees were already enjoying the 6th RoP with DA since January 1, 2006. The Forum recalled that when it met the chief secretary on March 12, 2010, the delegation was told that the state finance department would be instructed to prepare a cabinet memo for cabinet’s decision. The Forum expressed “utter surprise” that the chief secretary has come out with such a contradictory statement to what he had assured them through the press.
