HC quashes order

The Kohima Bench of the Gauhati High Court Monday quashed the order issued on December 15,2009 by the Deputy Commissioner Vigilance which had directed the Vigilance’s investigating team to release Rs.12 lakhs seized and kept on zimmanama to C.Sungit Ao petitioner who was the contractor for the Longkhum link road and the Mopungchukit link road scam in 2008.
The Bench gave the judgment on a criminal revision petition filed by the Director & DIG Vigilance and Anti-Corruption department against the order issued by the Deputy Commissioner Vigilance.
According to the petition, the confiscated money was given by the contractor of the link road C.Sungit Ao “ as gifts” to six accused- E.E.PWD(R&B) ; UDA-cum-Cashier PWD(R&B) ; Divisional Accounts Officer PWD(R&B) ; Jr.Divisional Accountant PWD(R&B) and another Jr.Divn. Accountant all under Mokokchung Division. During investigation, the six accused voluntarily surrendered the amount to the investigating team.
However, while the investigation was on, the Deputy Commissioner, Vigilance had issued an order on December 15,2009 for the release of the seized money to C.SUngit Ao.
Further the Court noted that the DC Vigilance had ordered the release of the money on to the petitioner on the plea that it was seized from him. The court noted that the money was never seized from C.Sungit Ao as averred by the lower court but that it was the amount “voluntarily surrendered” by the six accused to the probe team.
