Letter to DC Dimapur

It is felt necessary to write this letter to you and incharge of the department offices which falls within the Industrial Village Razhüphe Dimapur. The village land area which your department is presently occupying is yet to be acquired by the government. In this connection, as you are well aware, there is no inch of government land unless the land is acquired from the land owner in Nagaland. Moreover, the government is too young to occupy the traditional land of Nagas.
So, unless you collected the village patta from the village authority for your respective department for the occupied land within this village, your department has no legal right to use this village land though you may have government allotment order or government Jamabandi or government patta book because such so called government patta have no authority to protect your department’s claimed land within the village. Hence you are hereby informed to collect the village patta on or before 31st May, 2010 in respect of your department occupied land within this village in order to avoid any further complication. Moreover, the high court of Gauhati Kohima bench had repeatedly passed orders and directed that there shall be village patta within the village vide-WP (C) No. 136 (K) 2002 dated 10 March 2005. And as such you must follow the orders passed by the high court and it is not necessary for further approval of such high court orders from the government.
It is also important to be pointed out to you here that the so called government cadastral map was prepared without the traditional land owner. Also, the Industrial Village Razhüphe does not fall within the DTC or DMC. In this regard, your personal interest should not go against the traditional rights of the Nagas as well as the village. In case you violate the above mentioned orders knowingly and also our amicable settlement points made on 29th March’10 and failed to collect village patta, you will be held solely responsibility for ones compliance of the competent orders which will also compel me to reopen the closed chapter which went against you earlier.
