Murder accused set free after judgment

Two years after the March 19, 2008 murder case in Chumukedima, Block -1 where Nyimbemo Ngullie of Tsungiki village, Wokha was charged under section 302(A) for murdering his wife Elekha but set free by an order of the Additional District and Sessions Judge Monday. The court convicted Nyimbemo under section 304(A) carrying a sentence of two years imprisonment. However as he had served two years in custody, the court ordered his release. Nyimbemo Ngullie was later handed over to his relatives. Additional Public Prosecutor Akum, said conviction under 302(A) was either death penalty or life imprisonment with fine. He said based on arguments and evidences, the judge ruled that the murder was “non intentional” as the accused had no motive to kill his wife. Under section 304 (A) (causing death by negligence) the sentence carried a maximum punishment of two years imprisonment. Asked to comment the variance between the charge sheet u/s 302(A) and conviction u/s 304(A), Akum explained that a court has powers to delete, add and alter the sections of the IPC after thorough examination of the charge sheet, the witnesses and the circumstances.
