The All Nagaland Municipal and Town Council Forum (ANMTCF) urged the government to announce elections to civic bodies across the state by September 15. This was disclosed by members of the forum who spoke on condition of anonymity at a press conference held at Hotel Saramati Friday evening.
Citing excerpts from the Indian constitution and Nagaland Municipal Act 2001, the members pointed out that the elections should be conducted as there was ‘no ambiguity’ in both the acts. Asserting that the last town council dissolved was Medziphema on March 14, they maintained that the elections should also be conducted by September 14 since the six months would be completed by then.
Quoting from Article 243 (U) section 3 clause B, the members said election to constitute a municipality should be completed before the expiry of six months from the date of dissolution. Citing sections 10, 24 and 82 of the Nagaland Municipal Act 2001 they said there was no provision under any act to extend the period beyond the six months after dissolution.
They said the government would be acting against the acts and constitution, if it did not announce elections by September 14. Asked about their reaction, if the government did not respond, they said it would discussed only after September 15.
A total of 14 municipal and town councils excluding Mon, Peren, Phek, Tseminyu and Tuli attended the meeting.
