Four convicts in the sensational 2012 Nirbhaya Gang rape and murder case will be hanged on January 22 at 7 am in Tihar jail, a Delhi court said on Tuesday.

The order was pronounced by Additional Sessions Judge Satish Kumar Arora who issued the death warrants against the four death row convicts -- Mukesh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Kumar Singh (31).

During the hearing, the prosecution said there was no application pending before any court or the President right now by any of the convicts and the review petition of all the convicts was dismissed by the Supreme Court.

While urging the court to issue the death warrants, the prosecution said, “In between issuance and execution of death warrants of the convicts want to file curative petitions they can do so.”

The counsel for two of convicts - Mukesh and Vinay - said they were in the process of filing curative petition in the Supreme Court. As the judge pronounced the order, the courtroom was packed and thick with emotion. Nirbhaya’s parents as well as family members of the convicts wept. 

The trial court had earlier directed Tihar jail authorities to seek within a week response from four death row convicts as to whether they were filing mercy pleas against their executions with the President of India.

It was hearing the applications moved by Nirbhaya’s parents and the prosecution (Delhi government) seeking issuance of death warrant against the convict.

The 23-year-old paramedic student, referred to as Nirbhaya, was gang raped and brutally assaulted on the intervening night of December 16-17, 2012 inside a moving bus in south Delhi by six persons before being thrown out on the road. She died on December 29, 2012 at Mount Elizabeth Hospital in Singapore.

One of the six accused, Ram Singh, allegedly committed suicide in the Tihar Jail. A juvenile, who was among the accused, was convicted by a juvenile justice board and was released from a reformation home after serving a three-year term. The convicts have 14 days to use their final legal options. They will be in separate cells, in solitary confinement, and will be allowed one last meeting with their families.

Sources say the scaffold has been widened so all four can be hanged at the same time. Independent India would be seeing its first multiple execution with the four convicts due to be hanged in the gallows site in Jail No. 3 of the capital’s Tihar Jail complex on January 22.

Prepared to hang convicts: Hangman

Pawan Jallad, the probable hangman for the four accused in the Nirbhaya gangrape and murder case, said he is ready to hang them. Jallad, a third-generation executioner at the Meerut Jail, had expressed his desire to hang the four accused. Speaking to Aajtak after the order was pronounced, Pawan Jallad said, “I am ready to hang them.”

Elaborating on the procedure for the hanging, Jallad said, “I will reach Tihar Jail two-three days before the date. First, the gallows and the noose will be checked. Then their weight will be measured. Then we will conduct trials using sacks filled with sand a day or two before the hanging. They will be hanged till they don’t die.”

“I will be hanging them when I get the go-ahead from the superintendent. The superintendent, jailer and doctor will be present in the prison complex on the day of the hanging,” he added.

Pawan Jallad also clarified that no communication takes place with the death row convicts on the day of the hanging.

Jallad comes from a family of hangmen. His grandfather had carried out the hanging of the two men involved in the assassination of then prime minister Indira Gandhi besides notorious criminals Ranga and Billa.
