The Central Bureau of Investigation (CBI) filed a chargesheet against the four accused in the Hathras gangrape and murder case on Friday. In the chargesheet, the CBI has invoked charges of gangrape (sections 376, 376-A and 376-D IPC) and murder (section 302 IPC), against all four, besides also invoking sections of the SC/ST Act.

The CBI chargesheet was filed at a local court in Hathras. A 19-year-old Dalit woman was allegedly gangraped and murdered by four upper caste men in Hathras, Uttar Pradesh on September 14. She succumbed to her injuries a fortnight later at Delhi’s Safdarjung Hospital.

The victim was cremated in the dead of the night near her home on September 30. Her family had alleged they were forced by the local police to hurriedly conduct her last rites. Local police officers, however, claimed that the cremation was carried out “as per the wishes of the family”.

The “insensitive attitude” of the administration had invited some sharp remarks from the Allahabad High Court, which said, “The victim was at least entitled to a decent cremation in accordance with her religious customs and rituals which essentially are to be performed by her family.”

The four accused are currently in judicial custody. In its investigation, the CBI has looked into the role of the four accused who were also put through different forensic tests at the Forensic Science Laboratory in Gandhinagar.

The CBI investigators had also met doctors at the Jawaharlal Nehru Medical College and Hospital, where the victim was treated after the alleged gangrape on September 14. The CBI had registered the case on October 11, following a request from the Uttar Pradesh government, which was under immense public pressure over its handling of the case.

The chargesheet against the four accused was filed based on the last statement given by the victim on September 22. In an official statement, the CBI said, “CBI has today filed a chargesheet against four accused in the competent court in Hathras. The case was registered by CBI on October 11 on a request from Uttar Pradesh government and further notification from Government of India.” During its investigation, the CBI found out that one of the four accused is a minor according to his school marksheet. Making the claims, CBI pointed at the lapses in the investigation conducted by UP Police. The mother of the minor accused told India Today TV that a CBI team had visited their residence and taken the marksheet from her. She also claimed that her son is a minor. “They also took some of my elder son’s clothes along with the marksheet. He is a minor,” said the mother.

India Today TV had accessed the marksheet which mentions 2/12/2002 as his date of birth.
