Special POCSO court convicts one of rape

Special judge POCSO Act, Kohima, Neichochiyi Suyie, on June 16, 2020 convicted and sentenced accused Robert Debbarma to 10 years rigorous imprisonment and directed to pay fine of Rs. 5,000 for committing rape upon a minor child in July 2018.

A press release from special public prosecutor Kohima, Kathu Rengma stated that, accused person was arrested on January 28, 2019 based on FIR filed by a member of Child Welfare Committee, Kohima and case was investigated by UBSI Levinuo Nguwi who submitted charge sheet against the accused person. During trial, altogether eight prosecution witnesses were examined to prove the case. After hearing, the special public prosecutor and the defense counsel, the special judge, considering the evidence on record, ruled that accused Robert Debbarma, who was living with the prosecutrix in the same house, had committed rape upon the prosecutrix, who was about 13-year-old at the time of the incident and accordingly convicted the accused person on March 11, 2020 under section 376 (2) (f)(i)(j) of Indian Penal Code and under section 6 of the POCSO Act. 

Hearing on the quantum of punishment was taken up and accordingly on June 16, the special judge gave the final order and sentenced the accused person. Special judge also awarded a compensation of Rs. 1, 25, 000 to the prosecutrix under the Nagaland State Victim Compensation Scheme, 2012.

Meanwhile, public prosecutor Zunheboto J Khetoholi Yeputhomi reported that the court of district & sessions judge Zunheboto, Khesheli Chishi convicted accused Puloka Awomi and accused Pikato Shohe to undergo 10 years rigorous imprisonment under section 365/304 part 1 IPC for death of deceased victim Lunkholal Singson. Accordingly an amount of Rs. 2,00,000/- (two lakh ) only was awarded to the wife of victim under the Victim Compensation Scheme U/S 357 A of Cr.P.C. Judgment was pronounced on May 20, 2020.
